2.- File declared, in accordance with Andorran legislation, before the Data Protection Agency of the Principality of Andorra

In accordance with the requirements of Law 15/2003, of December 18, qualified for the protection of personal data (hereinafter, “LCPD”), and the regulations that develop it, interested parties are informed that any personal data provided to S.A.R.I. It will become part of a file of this entity duly registered with the Data Protection Agency of the Principality of Andorra.

3.- Purpose of the processing, legal basis of the processing and retention period of personal data

3.1.- Purpose of the treatment

SARI. will collect and process your personal data in order to manage any claims or incidents and requests for rights over your personal data related to contracting the ordering service. In accordance with article 11 of the EU General Data Protection Regulation (hereinafter “GDPR”), if S.A.R.I. is able to demonstrate that it cannot identify the interested party, it is not obliged to maintain, obtain or process additional information to do so. However, according to point 2 of said article, if possible (as it is in this case), we are obliged to inform you accordingly. In these cases, articles 15 to 20 do not apply, unless the interested party, in order to exercise their rights under these articles, provides additional information that allows their identification.

3.2.- Legal basis of the treatment

The processing is necessary for the execution of the corresponding contract with which you acquire the services or products of S.A.R.I..

3.3.- Conservation period for personal data

In general, your personal data will be kept for this purpose for 5 years and, if applicable, for the entire duration of the litigation and until all possible remedies have been exhausted.

4.- Categories of recipients, including service providers, and transfers to other countries or international organizations (international transfers)

4.1.- In the event that it is necessary to achieve the aforementioned purpose, your personal data may be communicated to the following categories of recipients:

• 1- S.A.R.I. service providers who have to process your personal data in relation to the purpose in question, doing so according to the instructions of S.A.R.I. and in accordance with this additional information and any appropriate security and confidentiality measures established by this entity.
• 2- Third parties that have no relationship with S.A.R.I., if it identifies, in good faith, the need to carry out the communication in question to: (1) comply with any law, regulation, legal procedure or governmental requirement with applicable enforceable force; (2) enforce the terms and conditions of the product and/or service purchased, including investigation of potential violations, and (3) detect, prevent, or otherwise address fraud, security, or technical issues.
• 3- Competent public administrations, in the cases provided for in the Law and for the purposes defined therein.

4.2.- S.A.R.I. does not carry out international transfers of personal data, in accordance with the provisions of the LCPD and the RGPD.

5.- Rights in relation to your personal data

In accordance with article 11 of the GDPR, the data that S.A.R.I. processed for the purpose of fulfilling your orders are not subject to the rights of access, modification, deletion, limitation and portability, unless you, in order to exercise your rights under articles 15 to 20, provide additional information that allow your identification.

In compliance with the LCPD, S.A.R.I. informs you that you can exercise your rights of access, rectification and deletion of your personal data, and in the event that you are in the European Union, in accordance with the RGPD, in addition to the previous rights, you may also exercise the rights to limitation of processing, to data portability and to object to processing.

You may exercise the aforementioned rights by sending a written and signed communication to the email address dpd@ordinoarcalis.com, to which you must attach a copy of your passport or other national identity document, the last four digits of the card with the one who made the payment and the approximate date and time of the order.

Likewise, you can obtain additional information about your rights and, if you consider it appropriate, file a complaint by contacting a data protection supervisory authority. In the event that you want to do so in the Principality of Andorra, we inform you that the Andorran Data Protection Agency (APDA) makes its contact information available to you at www.apda.ad.

SARI. guarantees that the processing that will be carried out on your personal data is subject to the strictest professional secrecy, and that the necessary measures, both technical and organizational, have been established to guarantee the security of your personal data and prevent its alteration, misuse , loss, theft and unauthorized treatment and access.
